These terms apply when you create a Haume account or use Haume. You accept them by entering the sign-in code we email you.
1. Who we are
Haume is run by one person, Adam Shand, a sole trader in New Zealand.
"Haume", "we" and "us" mean Adam Shand, trading as Haume, Waikanae, New Zealand. "You" means the person or organisation using Haume. You can reach us at support@haume.nz. If Haume later becomes a company, these terms will pass to that company and we'll tell you first.
2. Using Haume for your business
If you use Haume for a business, the Consumer Guarantees Act doesn't apply. If you're using it personally, it does.
If you're acquiring Haume for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply, and that this is fair and reasonable. If you're using Haume as a consumer, nothing in these terms limits your rights under that Act or the Fair Trading Act 1986.
3. Your account and your agent
Keep access to your email secure. You're responsible for what happens in your account, including what your AI agent does.
Your email address is how you sign in, so anyone who can read your email can use your account. Tell us straight away if you think someone else has access. You use Haume through an AI agent or other software acting for you. Anything it does in your account is treated as done by you, so only give it access you're comfortable with. Don't give your sign-in codes to anyone else, and never to someone claiming to be from Haume: we will never ask for them.
4. Your content
What you build is yours. You let us store, run and show it only so we can provide the service.
You keep ownership of everything you put on Haume: code, text, images, data and your visitors' data ("your content"). You give us permission to copy, store, run, back up and display your content only as needed to run Haume for you, and to fix problems. You confirm you have the right to use your content, and that using it on Haume won't break anyone else's rights. If your Site collects personal information from its visitors, you're responsible for handling it properly, including having your own privacy statement.
5. Acceptable use
Keep your Site lawful and don't use Haume to harm others or the platform.
You must not use Haume to:
- break New Zealand law or the law where your visitors are;
- host phishing, porn, malware, scams, or content that infringes someone's copyright or trade marks;
- send spam or unsolicited messages;
- harass, threaten or exploit anyone, or publish content that is objectionable under New Zealand law;
- attack, probe or overload Haume, other Sites, or anyone else's systems;
- get around Haume's limits or security, or use it to mine cryptocurrency or relay traffic for others.
Haume runs many people's Sites on shared servers, so one Site's misuse can harm everyone. We may act quickly when we see it (section 7).
6. Trial and paid Plans
Trial is free and private. Inactive Trial Sites are deleted after 30 days, with a week's warning. Going Live needs a paid Plan.
New accounts start on the free Trial. On Trial you can build and preview your Site privately, but you can't publish it to the public or use a custom domain, and your Site can't connect out to the internet. If nobody uses a Trial Site for 30 days, we'll email you a warning and delete it 7 days later unless you use it again. Your account stays, so you can start a new Site any time.
Paid Plans let you publish your Site. Prices are on haume.nz/pricing, in New Zealand dollars including GST. You pay monthly, in advance. We don't refund past months, but you can cancel any time and won't be charged again. We'll give you at least 30 days' notice of any price change, and you can leave before it applies.
7. Suspension and leaving
You can leave any time. We'll only suspend or close your account for a good reason, and usually with notice.
You can close your account or cancel a paid Plan at any time; a paid Plan runs to the end of the period you've paid for. We may suspend or remove a Site or account if you seriously or repeatedly break these terms, don't pay, or if your Site puts other people, other Sites or Haume at risk. We'll tell you why and give you a chance to fix things first, unless the risk is urgent (for example phishing or malware), when we may act first and tell you straight after.
Before we delete a paid Site, you'll have 30 days to download your content. Trial Sites are deleted as described in section 6.
8. The service
We take care to keep Haume running and your content backed up, but we can't promise it will always be available.
We'll operate Haume with reasonable care and skill, and keep regular backups. Haume is a small service run by one person, so there's no guaranteed uptime: outages, maintenance and data loss can happen. Keep your own copy of anything important; your Site's code is in Git, which you can clone at any time. We may change or stop features. If we close Haume altogether, we'll give you at least 60 days' notice and help you take your content with you.
9. Liability
If something goes wrong, our liability to business customers is limited to what you've paid us in the last 12 months.
If you use Haume for a business, and to the extent the law allows: we aren't liable for indirect or consequential loss, such as lost profits, revenue or data; and our total liability to you for all claims is limited to the amount you paid us in the 12 months before the claim. This doesn't limit liability we can't legally limit, such as for fraud. If you're a consumer, these limits don't reduce your rights under the Consumer Guarantees Act or the Fair Trading Act.
If your content or your use of Haume causes a claim against us (for example, a copyright claim over your content), you'll be responsible for the reasonable costs of dealing with it.
10. Changes to these terms
If we change these terms, you'll see the new version the next time you sign in. If you don't agree, you can leave.
We may update these terms, for example when Haume changes or the law does. Each version has a date. When we make a change that matters, we'll show it in your next sign-in email, and it applies once you sign in with that code. For a change that affects paid Plans, we'll also email you at least 30 days ahead. If you don't agree, you can close your account before it applies. Older versions stay available at haume.nz/terms/[version].
11. Complaints, takedowns and problems
If something on a Haume Site is harmful or infringes your rights, contact support@haume.nz and we'll look into it promptly.
To report content on a Site hosted by Haume, email support@haume.nz with the Site address, what the problem is, and why. For a complaint under the Harmful Digital Communications Act 2015, we'll pass it to the Site owner within 48 hours, and remove or disable the content if they don't respond, or agree, within the time the Act allows. For copyright infringement, we'll act on a valid notice as the Copyright Act 1994 requires. We may also remove content straight away if it's clearly illegal or a risk to others.
If you have a complaint about Haume itself, email us and we'll try to sort it out with you directly.
12. Law and disputes
New Zealand law applies. Let's try to sort out any disagreement together first.
These terms are governed by New Zealand law, and New Zealand courts have jurisdiction. If we disagree about something, we'll each try in good faith to resolve it by talking before going further. If any part of these terms can't be enforced, the rest still applies. Not enforcing a term straight away doesn't mean we've given it up.
